14. I take judicial notice of the fact that paragraph 6.4.1 of the relevant municipal by-law says:

The minimum floor area for a Lodging Unit shall be not less than 7m2 (75 sq. ft.) for single occupancy and 4.6m2 (50 sq. ft.) per Person for multiple occupancy.

15. If the Landlord is correct and the unit is 300 square feet this would mean that the presence of three people living in the unit is not a breach of the relevant by-law.

16. The Landlord also says that the walls are not sound proof and the presence of a crying child disturbs others in the building. That is why she told the Tenants the building was adults only.
