Writing a Factum

Overview
Parts of the Factum
- PART I (The Applicant and the Respondent)
- PART II (Nature of the Case & Issues)
- PART III (Summary of the Facts Relevant to the Issues)
- PART IV (Statement of each issue raised, with argument)
- PART V – ORDER SOUGHT
Factums are written slightly differently depending on whether or not the factum is being written for an appeal or for a standard application.
It is important to know that factums rely on sworn evidence that is either already on the record or is based on a sworn affidavit of a party.
How to start
When writing a factum the first thing you need to do is have a summary version of your timeline of events. Not the full timeline but a shortened version, this will help give structure to your writing process.
